Learner driver charged with drink driving

A police officer was assaulted by an intoxicated passenger in a car driven by a learner driver who was also allegedly affected by alcohol.

A 26-year-old man and a 20-year-old woman will appear in the Brisbane Magistrates Court after an incident on Waterworks Road, Ashgrove this morning.

Police conducting traffic operations on Waterworks Road, Ashgrove, at 3.20am intercepted when a 20-year-old female on a learner's permit. It is alleged a roadside breath test was positive. A second test on the driver cleared her of drink driving.

The 26-year-old male passenger responsible for supervising the learner driver was also required to provide a breath sample and his also allegedly returned a positive result.

The officer was video recording the incident when the male passenger allegedly assaulted the male Constable. The officer was punched in the face causing a swollen jaw and also minor injuries to his elbow, wrist and hip after he fell to the ground.

The 26-year-old man, from The Gap, was arrested and charged with serious assault on police and also being in charge of a motor vehicle with a blood alcohol concentration.  He will appear in the Brisbane Magistrates Court on January 17.
