In accordance with sections 710 of the Police Powers and Responsibilities Act 2000:
The Commissioner of Police possesses an analyst's certificate relating to the drug matters below.
Within 30 days after the notice below is given, you may give the Commissioner a written notice (analysis request) requiring the Commissioner to make a representative sample of the drug matter available to an appropriately qualified person (independent analyst) for analysis.
If you do not give the Commissioner written notice within 30 days, the Commissioner may destroy the drug matter.
If, after receiving an analysis request, the Commissioner is satisfied the independent analyst named in the request has the qualifications necessary to analyse the drug matter, the Commissioner may make a representative sample of the drug matter available to the independent analyst for analysis, within 5 business days, at a time and place decided by the Commissioner and on conditions the Commissioner considers appropriate.
However, if the Commissioner is not satisfied that the independent analyst has the qualifications necessary to analyse the drug matter, the Commissioner may require you to nominate another independent analyst within 30 days.
If you do not give the Commissioner an analysis request naming another independent analyst within 30 days, the Commissioner may destroy the drug matter in the way the Commissioner considers appropriate.
If the Commissioner makes a sample of the drug matter available to the independent analyst, the Commissioner may destroy the drug matter from which the representative sample was made available at the end of 10 business days after the Commissioner made the representative sample available to the independent analyst.
